Increase in compensation limits and new rates for 2009
From 1 February 2009, the limits applying to certain awards payable under employment legislation will increase.
The main changes are:
• The maximum compensatory award for unfair dismissal will be increased from £63,000 to £66,200. (Note that the amounts are uncapped in cases of discrimination.)
• The maximum weekly wage used for calculating a week’s pay (for the purposes of calculating a basic award for unfair dismissal or for a redundancy payment) will be increased from £330 to £350.
• The limit on amount of guarantee payment (where guarantee payments are contractually allowed) payable to an employee in respect of any day will be increased from £20.40 to £21.50.
From April 2009, the following statutory payments will also increase.
• Statutory maternity, adoption and paternity pay will rise from £117.18 to £123.06 per week.
• Statutory sick pay will be increased from £75.40 to £79.15 per week.
• The lower earnings limit will rise from £90 to £95 per week.
